TERMS OF USE FOR THE SUPERBID INTERNET PORTAL (www.superbid.net)
- 1) To participate in the auctions published on the Superbid Internet PORTAL, the user must provide their personal information. In order to register correctly, it is essential to supply true, current, complete and accurate information as prompted by the registration form. We also require that the user maintain and promptly update such information to keep it true, current, complete and accurate.
- 2) When signing up, select a username, (a personal identifier) within the Superbid Internet PORTAL. We also require the user to enter a personal and nontransferable password, which cannot be used for further unauthorized purposes
- 3) The login information provided must not bare any similarity with either the Superbid name or the names of companies owning assets disclosed on the Superbid PORTAL. Furthermore, this information may not, in any way contain offensive language, personal data, a URL or an email address.
- 4) If the user does not want to be recognized by other users of the Superbid Internet PORTAL, we recommend that the user choose an unidentifiable username.
- 5) As a security measure, the user’s password and data will be transmitted with encryption. (SSL Security Certificate – Secure Socket Layer).
- 6) The user undertakes to keep their account details strictly confidential and the user must not permit any third party to use or access the user’s account on their behalf or otherwise. The user will be liable for any and all bids made via their account. In the case of unauthorized use of the password, the user agrees to immediately contact the Superbid Internet PORTAL Service Center via email, communicating the fact, under penalty of incurring losses and appropriate damages.
- 7) IN REGISTERING, ALL USERS AUTHORIZE SUPERBID INTERNET PORTAL TO CHECK BACKGROUND DATA & CREDIT DETAILS WITH CREDIT PROTECTION BODIES.
- 8) The Superbid Internet PORTAL Call Center will contact the user via email or phone if any discrepancies in the data provided by the user are found. Likewise, if there are any outstanding fees or payments.
- 9) Once the user’s information has been processed and verified, access to the Superbid Internet portal should be made available within 01 (one) business day.
- 10) The registered user will need to sign up on the Superbid Internet PORTAL for each Sale that he/she wishes to bid on. An “Auction Notice” will then be sent via email requesting confirmation.
- 11) Whenever necessary, the auctions will be conducted by an official Auctioneer, legally qualified to perform the duties for Tip-Staff, (public servant appointed by a judge,) or in the case of auctions of Municipalities and Public Bodies; a named Public Servant. These auctions will occur on a date, time and place previously determined and announced in notices published in major newspapers and on the Superbid Internet PORTAL.
- 12) Bids may be made through the Superbid Internet PORTAL and / or in person (until the time the auction closes). The user acknowledges that they are bidding in a live auction and they agree that each bid submitted as provided in these terms and conditions is irrevocable and cannot be amended or corrected under any circumstances, even if submitted in error and notified to us. The user accepts full liability for all bids submitted via their account.
- 13) The User may offer more than one bid for the same item, acquiescing that the greater submitted bid will be prevalent. The Superbid PORTAL allows for simultaneous real time face-to-face and virtual bidding.
- 14) Superbid Internet PORTAL allows the user to program automatic bids, so that if another user covers your bid, the system will automatically generate a new bid increasing your bid by a fixed and predetermined amount, up to a maximum limit set by the User with the objective that makes sure that by the amount set your bid is the winner. Automatic bidding will be recorded in the system with the date they are scheduled.
- 15) Each bidding lot has a set closing time (clock available in the “bid screen” section of the PORTAL). If any offer is made within three (03) minutes of the lot closing, the timer will be reset to three (03) minutes of the lot closing, allowing all interested users the opportunity to make new calculated bids. This will occur indefinitely until no more bids are placed.
- 16) If a bidder fails to make any payments, we reserve the right to suspend or terminate access to any aspect or feature of the Superbid Portal. The user’s account will be blocked and any other account identified as pertaining to the defaulting bidder, will also be blocked.
